APPLICATION: Staff Approval No. SA2007-010 (PA2007-130)
REQUEST: Request to modify the provisions of a previously
approved sign program that pertain to one sign location and to change the
vertical dimension from 24 inches to 30 inches. Previous approval of
Modification Permit No. 2005-120 (PA2005-262) established a comprehensive sign
program for the shopping center.
LOCATION:
Section 20.42.060 C of the
Newport Beach Municipal Code provides that the Planning Director may review and
approve plans, applications or other information for consistency with the
Mariner Mile Design Framework.
ACTION: Approved August 21, 2007 - The
Planning Director approved the request to modify the
provisions of a previously approved sign program that pertain to one sign
location and to change the vertical dimension from 24 inches to 30 inches and
allow a horizontal dimension of 10 feet where the Zoning Code limits the sign
to 8.5 feet. Previous approval of Modification Permit No. 2005-120 (PA2005-262)
established a comprehensive sign program for the shopping center. The approved
Table-Matrix supercedes the Table-Matrix for Modification Permit No. 2005-120
(PA2005-262).
FINDINGS
1. The change to the sign program is consistent with the overall
provisions and does not increase the number of signs otherwise allowed by the
existing sign program.
2. The property owner is afforded a location for a single tenant wall sign
or multiple identification purposes for tenant spaces that do not have tenant
frontage that is visible from the public street.
CONDITIONS
1.
The table matrix for
Modification Permit No. 2005-120 (PA2005-262) as approved on November 21, 2005 is
rendered null and void and is superseded by the attached revised Table*-Matrix
dated August 20, 2007. All other provision of the sign program have been
retained.
2.
All applicable requirements of
Chapter 20.67 of the Newport Beach Municipal Code shall apply.
3.
The Planning Director or the
Planning Commission may add to or modify conditions of approval to this use
permit, or revoke this permit upon a determination that the operation, which is
the subject of this approval, causes injury or is detrimental to the health,
safety, peace, morals, comfort or general welfare of the community.
APPEAL PERIOD
The
decision of the Planning Director may be appealed by the applicant or any
interested party to the Planning Commission within 14 days of the decision
date. Any appeal filed shall be accompanied by a filing fee of $600.00.

Discussion
The
applicant requests to modify the sign program to accommodate a minor increase
in the vertical dimension allowed for the previously approved breezeway sign
location. The area and location as approved is consistent with the Chapter
20.67 Sign Code provisions.
