City Code is essential to protecting public health, safety, and quality of life. To improve this process, the City has created an administrative code enforcement program that offers a fair, efficient alternative to traditional court proceedings. This program eases the burden on the judicial system while ensuring due process for anyone cited for a violation.

Enforcement Officers may issue administrative citations to anyone responsible for violating the City Code. Each day a violation continues is considered a separate offense. Administrative fines are issued through these citations and must be paid directly to the City.

It may take several days to a week for an administrative citation to appear in the system. When looking up your citation please enter the citation number exactly as it appears on the violation notice. For administrative citations issued by the Police Department, the format is AD#####D.

Any person violating any provision of the Newport Beach Municipal Code or applicable State Code may be issued an administrative citation. Each and every day that a violation occurs constitutes a separate and distinct offense.

The failure to pay the fees or fines assessed within the time specified may result in the matter being referred to a collection agency. Any unpaid fees or fines will be assigned to a collection agency approximately 90 days after the original due date. At that time, 30% of the original fee will be added to the fine for collection/recovery costs.

The City of Newport Beach is committed to ensuring a fair and impartial administrative hearing process. The purpose of an administrative hearing is to provide individuals with the opportunity for due process by allowing an impartial evaluation of the validity of a citation. The Administrative Hearing process is governed by the City of Newport Beach Municipal Code, Chapter 1.05 – Administrative Code Enforcement Program (Click Here). Any recipient of an administrative citation may file an appeal. A request for administrative hearing form must be submitted to the City along with an advanced deposit of the fine within 21 days of the issue date. The 21-day deadline is strictly enforced.

Any fine shall be refunded if it is determined through the administrative hearing process that the person charged was not responsible.

An administrative citation for non compliance of a business license cannot be disputed in person or via telephone, unless the entity or individual that has been cited has a valid business license tax certificate from the City of Newport Beach you can call 949-644-3141. You may log on to the City website at www.newportbeachca.gov go to on-line services, apply for a Business License and/or download a Request for Administrative Hearing. This form will allow you to describe why you believe you are not subject to the business license tax. Your form must be received by the Revenue Division by the correction date noted on your citation. ADMINISTARTIVE CITATION FINES

The City has assessed different fine schedules depending on the following criteria: violation cited, whether the violation has been designated an infraction or where the violation is not designated an infraction, prior violations within a 12-month period, and/or the violation occurred in a Safety Enhance Zone. All administrative citation fines are available under NBMC 1.05.020 or applicable municipal code section. Designated an Infraction:

1.    A fine not exceeding one hundred dollars ($100.00) for a first violation;

2.    A fine not exceeding two hundred dollars ($200.00) for a second violation of the same ordinance within one year from the date of the prior violation; and

3.    A fine not exceeding five hundred dollars ($500.00) for each additional violation of the same ordinance within one year from the date of the prior violation.

Not Designated an Infraction:

1.    A fine not exceeding two hundred dollars ($200.00) for a first violation;

2.    A fine not exceeding three hundred dollars ($300.00) for a second violation of the same ordinance or permit within one year from the date of a prior violation;

3.    A fine not exceeding six hundred dollars ($600.00) for a third violation, or any subsequent violation, of the same ordinance or permit within one year from the date of the prior violations.

*Please note there are separate fine schedules depending on the violation and if the violation was in the Safety Enhancement Zone.
